Court Closures Due to Hurricane Gustav

Eastern District of Louisiana: This court reopened today, Monday, September 8. All deadlines, delays and prescriptive periods are suspended until September 8. E-filing is available; all deadlines, delays, and prescriptive periods are suspended for attorneys with law offices in Terrebonne and Lafourche Parishes until Monday, September 22, 2008.

Middle District of Louisiana: This court reopened today, Monday, September 8. The Louisiana Middle District courthouse is fully operational. Deadlines for September 2nd through September 5th are extended until 5pm on Monday, September 8th. E-filing is available.

Western District of Louisiana: This court is open. No orders regarding deadlines have been issued. The clerk's office states that any continuances, extensions, etc. will be dealt with on a case by case basis.

U.S. Fifth Circuit: This court reopened today, Monday, September 8. All filing dates falling within the time the court was closed due to Hurricane Gustav are automatically extended until September 10, 2008.

U.S. Bankruptcy Court - Eastern District of Louisiana: This court is tentatively set to reopen today, Monday, September 8. All contested matters set on September 3 are rescheduled for September 17. E-filing is temporarily unavailable.

U.S. Bankruptcy Court - Middle District of Louisiana: This court is set to reopen today, Monday, September 8. There is no information regarding deadline extensions. E-filing is available.

Executive Order No. BJ 08-92
According to Executive Order No. BJ 08-92, Governor Jindal has ordered that all deadlines in legal, administrative, and regulatory proceedings, including liberative prescriptive and preemptive periods in all courts, administrative agencies, and boards are suspended until Friday, September 12, 2008. This order applies to the following courts:

Supreme Court of Louisiana: This court is set to reopen today, Monday, September 8. All filings due during the period of closure shall be deemed timely filed if filed within 5 days of the resumption of normal Court operations. Due to Hurricane Gustav, the Louisiana Supreme Court has cancelled oral arguments scheduled for September 3, 4 and 5, 2008. Cases will be rescheduled to be heard the week of October 13, 2008.

First Circuit Court of Appeal: This court is set to reopen today, Monday, September 8. Information is not available regarding deadline extensions.

Second Circuit Court of Appeal: This court is open. There is no information regarding deadline extensions. Filings due Filings due on September 2 were accepted on September 3.

Third Circuit Court of Appeal: This court is open. All filings due during this period of closure shall be deemed timely filed if filed within 10 business days of the resumption of normal Court operations which shall be posted on its website at www.la3circuit.org.

Fourth Circuit Court of Appeal: This court is set to open tentatively on Monday, September 8. Any filing deadline that occurs during the time of closure or on the date the Court re-opens shall be extended by seven days from the date the Court re-opens.

Fifth Circuit Court of Appeal: This court is set to open today, September 8. All deadlines, delays and prescriptive periods are suspended until Monday, September 8. Electronic filing is temporarily unavailable.

Calcasieu; 14th JDC: If you were scheduled to appear in Court on Thursday or Friday and were unable to attend, you will be required to provide documentation regarding your evacuation.

East Baton Rouge; 19th JDC: This court is scheduled to reopen today, Monday, September 8. No information is available regarding deadline extensions. The Real Estate Filing Offices are set to reopen today, Monday, September 8. Normal operations, including the holding of rule day will resume on Monday, September 8, 2008. The time off will be treated like a legal holiday.

Jefferson; 24th JDC: This court and the Real Estate Filing Offices are scheduled to reopen today, Monday, September 8. No information is available regarding deadline extensions. The legal community may continue to file pleadings via e-filing and fax filing.

Lafayette; 15th JDC: This court is scheduled to reopen today, Monday, September 8. There is no information available regarding deadline extensions nor the real estate filing offices.

Lafourche; 17th JDC: This court is scheduled to reopen Monday, September 15. There is no information available on filing extensions. Nor is there any information regarding the Real Estate Filing Offices.

Orleans; Orleans Civil District Court: This court is scheduled to reopen today, Monday, September 8. A Duty Judge is available to handle all emergency matters and can be reached by calling 1-504-592-9100, the emergency number at 1-866-501-2038 or by email at DutyJudge@yahoo.com. (Judge Landrieu).

Orleans; Orleans Criminal District Court: This court is scheduled to reopen today, Monday, September 8. Jurors due to report to Orleans Parish Criminal District Court are ordered to appear on Monday, September 15, 2008 at 8:30 a.m.

St. Bernard; 34th JDC: This court is scheduled to reopen today, Monday, September 8. There is no additional information available.

St. Charles, 29th JDC: This court is scheduled to reopen today, Monday, September 8. There is no additional information available.

St. Tammany; 22nd JDC: This court is scheduled to reopen today, Monday, September 8. There is no additional information available.

Terrebonne; 32nd JDC: This court is scheduled to reopen Monday, September 15. There is no additional information available.

West Baton Rouge; 18th JDC: This court is scheduled to reopen Monday, September 8. Plaquemine Courthouse, Division D will be open on Monday. Judge William Dupont will accommodate any attorneys that can not attend with a new date.
