Michael Walshe to Speak on Offensive Trademarks
Michael Walshe will speak at the Federation of Defense & Corporate Counsel Winter Meeting on March 7, 2015. He will participate in the panel presentation "Offensive Trademarks: What’s In a Name?" at 7:30 a.m.
The recent Blackhorse decision by the Trademark Trial and Appeal Board (the “TTAB”) cancelling six registrations owned by the Washington Redskins on the grounds that the REDSKINS marks were disparaging made headlines because of the fame of the marks in question. But such actions by the TTAB are not unique. This presentation will discuss the standard for cancellation of marks and highlight various marks that have been found disparaging, as well as others that have survived such a challenge.
