We counsel clients on their rights and obligations as a fiduciary, such as an executor or trustee, and advise them on "best practices" to avoid litigation. We also represent heirs and trust beneficiaries, advising them on their rights, monitoring probate proceedings and/or trust administration on their behalf, and advising them on how to most effectively correct issues.
Stone Pigman advises executors, trustees and other fiduciaries in the proper execution of their duties and also handles fiduciary litigation, including will contests, trust disputes, breach of fiduciary duty claims and interdiction (guardianship) proceedings. Stone Pigman has pursued and defended will contests based upon lack of capacity and undue influence and forced heirship claims, and has both defended trustees against breach of fiduciary duty claims and pursued such claims by beneficiaries against trustees.
